Board of Trustees concerned with province’s Prompt Payment Act

The Halton District School Board of Trustees approved a recommendation at its Wednesday, January 30, 2014 meeting to send a letter to the provincial government outlining concerns with the proposed Prompt Payment Act, 2013.

The Bill, which focuses on progress payments for construction work, received second reading approval from the Ontario Legislature in May 2013. Prior to third reading consideration, the Halton District School Board strongly urges open public consultations on this Bill. The Board acknowledges timely payment to contractors for acceptable work completed within the terms of the construction contract. However, in the letter sent to Kathleen Wynne, Premier of Ontario about the Prompt Payment Act, 2013, Trustees outlined concerns including:

  • the language contained within the draft Bill has significant gaps that will result in added school construction costs
  • impacts on taxpayer-funded budgets
  • delays school project openings within communities
  • results in potential over-payments to contractors
